These Terms of Service ("Terms") govern your access to and use of the Bitcode AI platform, software, services, and website located at bit-code-ai.com (collectively, the "Platform"). Bitcode AI provides an algorithmic cryptocurrency trading platform that utilizes artificial intelligence and neural network analysis to generate trading signals and automate trading strategies across digital assets including Bitcoin, Ethereum, and other supported cryptocurrencies. The Platform connects to third-party broker partners and exchanges to execute trades on your behalf based on your configured preferences and risk parameters.

We provide software tools, market analysis, and educational resources. We do not provide investment advice, financial planning services, or recommendations to buy or sell specific digital assets. All trading decisions remain your sole responsibility.

4. Risk Disclosure and No Guarantee of Profits

Cryptocurrency trading involves substantial risk and is not suitable for all individuals. Digital asset prices are extremely volatile and can result in significant losses, including total loss of invested capital. Automated trading systems carry additional risks including technology failures, software errors, connectivity disruptions, market manipulation, and unexpected algorithm behavior.

Past performance of the Platform, specific trading strategies, or individual cryptocurrencies is not indicative of future results. We make no guarantees, representations, or warranties regarding profitability, performance, or outcomes. You acknowledge that you may lose some or all of your invested funds and agree to trade only with capital you can afford to lose entirely.

The Platform facilitates connections to third-party cryptocurrency brokers, exchanges, and liquidity providers. These third parties are independent entities not controlled by Bitcode AI. Your trades execute subject to the terms, conditions, fees, and regulatory oversight of these third-party partners. We are not responsible for the actions, omissions, services, security practices, or solvency of any third-party broker or exchange.

You acknowledge that third-party platforms may experience downtime, technical issues, or insolvency that could impact your ability to access funds or execute trades. We recommend reviewing the terms of service and regulatory status of any connected broker or exchange.

6. Fees and Payments

Use of certain Platform features may require payment of subscription fees, trading commissions, or other charges as disclosed during the registration or upgrade process. All fees are non-refundable unless otherwise stated in writing. Third-party brokers and exchanges may charge additional fees including trading commissions, spreads, withdrawal fees, and network transaction costs.

You authorize us to charge your designated payment method for all applicable fees. Failure to pay fees may result in suspension or termination of your account and access to the Platform.

The Platform, including all software, algorithms, user interfaces, designs, text, graphics, logos, and trademarks, is owned by Bitcode AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works based on the Platform or any proprietary technology without our express written permission.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITCODE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

You agree to indemnify, defend, and hold harmless Bitcode AI, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Platform, violation of these Terms, infringement of any intellectual property or other rights, or any trading losses incurred.

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including for violation of these Terms, fraudulent activity, or extended inactivity. Upon termination, your license to use the Platform immediately ceases. You may terminate your account at any time by contacting customer support. Sections of these Terms that by their nature should survive termination shall remain in effect.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions or class arbitrations.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision. You may not assign or transfer these Terms or your account without our prior written consent.
